Medical Malpractice

Understanding medical malpractice is a difficult task. Doctors, nurses and other medical professionals can sometimes be negligent, or even careless, in handling your serious medical matter. There are many ways doctors and other medical professionals may be found negligent:

  • Preventable injuries that occur while in a hospital

  • Improper distribution of anesthesia

  • Misdiagnosis

  1. Preventable injuries that occur while in a hospital

Hospitals have a duty to ensure safe care of their patients. Many times, a hospital will hire an incompetent doctor, nurse, or medical technician. As a result, the hospital will more than likely be held liable. These preventable injuries could be anything such as misdiagnosis, wrong surgery, or even wrong medication.

  2. Improper distribution of anesthesia

Anesthesia is the initial step prior to the start of surgery, if it is needed. Anesthesia is used in order to give the patient a temporary loss of sensation or awareness. It may include some some of relieve from pain, paralysis, amnesia, and even unconsciousness. As you can tell, anesthesia is an important step in order to have a successful procedure. However, many times, there are errors in administering the anesthesia. Negligently handling anesthesia means that there is a possibility that the patient awakens while the surgery is taking place. This can be a traumatic experience.

  3. Misdiagnosis

Misdiagnosis, or even a delayed diagnosis, is another traumatic, horrific experience. Unfortunately, it happens very often. Sadly, many misdiagnosis’ come in the form of diagnosing cancers such as breast or lung cancer. In order to have a successful malpractice claim for a misdiagnosis, you have the burden of proving that the cancer, for example, was noticeable prior to the misdiagnosis.
